who we are

Hyperblob Studio ("we", "us") makes the Wiggle Together app for iPhone and this website, wiggletogether.com. These terms are the agreement between you and us about using them. Questions go to [email protected].

agreeing to these terms

By signing in to Wiggle Together, as a guest or with Apple, or by using it in any other way, you agree to these terms and to our privacy policy, which explains what we collect and why. If you don't agree, please don't use Wiggle Together.

the app

The app is licensed to you, not sold, under Apple's standard Licensed Application End User License Agreement, which you accept when you get it from the App Store. That agreement covers installing and using the app on your Apple devices, and it is part of these terms. These terms add the rules for everything the app connects you to: your planet, your moons, space, and what people share there. Where the two differ about the license to the app itself, Apple's agreement applies.

These terms are between you and us, not Apple. Apple isn't responsible for Wiggle Together or what's in it, and has no duty to support it.

who can use it

You must be at least 13 to use Wiggle Together. If you're under the age of majority where you live, you need a parent's or guardian's permission, and they agree to these terms for you. If we learn that someone under 13 has an account, we delete it.

your account

The first time you open the app, it makes a guest account for you, kept with your iPhone. Sign in with Apple to keep your planet on any iPhone. You're responsible for what happens with your account, so keep your phone secure. Don't sell or hand over an account, and don't make new ones to get around a report, a limit or a restriction.

be kind

Wiggle Together is a place to make small things with people. We have zero tolerance for objectionable content and for people who abuse others. Don't draw, color, send or throw into space anything, or choose a nickname, that:

• is sexual, shows nudity, or sexualizes anyone, and never anything involving a child;
• threatens, harasses, bullies or humiliates anyone;
• attacks people for who they are, such as their race, ethnicity, religion, disability, sex, gender, sexual orientation or age;
• shows or encourages violence, cruelty, self-harm or suicide;
• shares anyone's personal information, such as a name, address, phone number or account, or a picture of a real person without their permission;
• promotes illegal activity, drugs, weapons, gambling or scams, or advertises anything;
• copies someone else's work, or otherwise breaks someone's rights, such as copyright or trademark.

And don't:

• flood space, or use bots, scripts or other automation to make, throw or catch doodles;
• try to find out who someone is, or reach them outside the app, from what they draw;
• interfere with the app or our servers, try to get at anything that isn't yours, or get around a limit, a report, a block or a restriction;
• copy, reverse engineer, resell or rent the app or anything in it, except where the law allows.

reports

• Anything can be reported. Every stranger's doodle has a report link, and so does a friend's doodle on a moon. Reporting a stranger's doodle also hides it, and everything else that person puts in space, from you straight away. On a moon, you can always leave.
• We act within 24 hours. A doodle two people report leaves space for everyone while we look at it. When something breaks these rules, we take it down, and we can limit what the account behind it shows other people, or close the account, with or without warning.
• We don't check every doodle before it's shared, and we aren't responsible for what other people make. But we act on every report. If something is urgent, email [email protected]. If someone is in danger, call your local emergency number.

your doodles

What you make is yours. By making it in Wiggle Together, you give us a worldwide, non-exclusive, royalty-free license to store, copy, show and deliver it where you send it (to a moon, into space, or back to whoever drew the lines you colored), and to change it only as the app needs to show it, such as its wiggle and its size. We use this license only to run Wiggle Together.

It ends when you delete the doodle or your account, except for what stays by design, as the privacy policy explains: doodles you left on a moon stay there for your friend, and colorings strangers made of your public doodles stay theirs, with your lines in them.

Coloring someone's doodle makes something new from their lines and your colors. While your coloring is public, the person who drew the lines can see it.

Only make and share what you have the right to. If you think a doodle copies your work, email us with what it is and where you saw it.

spacefish and upgrades

• Spacefish are the app's own currency. Every planet starts with a few, you can buy more, and you spend them in the app, on things like markers, tubeperson styles and bringing back a lost streak. They have no cash value: they can't be exchanged for money, sold, or moved to another account, and they don't expire.
• A super planet is a one-time upgrade for your planet. It lives on one planet at a time, and restore purchases can move it to another of yours, once every 30 days. A super moon upgrades one moon, for both people on it, for as long as the moon is there.
• What you buy is a license to use it in the app, not property. It belongs to your account in the app, not to your Apple Account, so sign in with Apple to keep it when you change phones.
• Apple takes every payment, under Apple's terms, and decides on refunds: ask at reportaproblem.apple.com. If a purchase is refunded, we take back what it gave, and a spacefish balance can go below zero.
• If an account is deleted, by you or by us for breaking these terms, its spacefish, purchases and upgrades go with it and can't be brought back.
• Things can change. We may change what's offered and what it costs. We won't take back something you've bought, unless it's refunded or the account is closed.

changes, and the end

We keep working on Wiggle Together: features, limits and styles can change, and parts of it can stop. We'll tell you in the app before anything important changes. You can stop using it at any time, and delete your account in the app: My Account, then delete my account. We can suspend or close an account that breaks these terms or puts other people at risk, and we can stop offering Wiggle Together altogether. If we ever do, we'll tell you in the app ahead of time.

no promises beyond these

We make Wiggle Together with care, but it comes "as is" and "as available". As far as the law allows, we make no promises about it beyond what these terms say, including that it will always work, be free of mistakes, or keep every doodle forever. Keep what matters to you: you can save any doodle to your photos.

our responsibility

As far as the law allows, we aren't responsible for indirect or unforeseeable losses, for lost data, or for what other people do in the app, and our total responsibility for any claim about Wiggle Together is limited to the greater of what you paid for in-app purchases in the 12 months before it, or US$50.

Nothing in these terms takes away rights you have under consumer law that can't be taken away, or limits our responsibility where the law doesn't allow it to be limited.

changes to these terms

If we change these terms, we'll update the date at the top, and tell you in the app if the change is significant. Using Wiggle Together after a change means you accept the new terms.
